(Cross-border Healthcare) NHS Implementation Group

An NHS Implementation Group has been set up to consider the challenges raised by the patient mobility and cross-border healthcare agendas. The aim of the group is to help ensure that the NHS recognises and acts on the obligations placed upon it by existing case law, by the recent Regulations and Secretary of State’s Directions published by DH (which came into full effect from 23 August) and to take full account of the requirements of the forthcoming Directive.

The group will work with DH to lead on the operational implementation of the European case law and proposed EU Directive on cross border healthcare by NHS organisations. It will consider the operational implications of the obligations set forward by the case law and the Directive, to ensure that there is consistent application of legislation and guidance on this matter throughout the NHS and ensuring that any issues around implementation are identified. The group will also act as a strategic “sounding board” on cross-border healthcare issues, reporting to DH and Ministers on barriers to progress.

Key roles:

- Work with DH and others (eg the Devolved Administrations) to identify ways in which the obligations contained in the Cross-border healthcare case law and Directive can be embedded and delivered consistently at both a national and local level by the NHS;

- Help produce a set of products to aid the NHS in embedding these obligations;

- Maintain a strategic overview and provide advice to DH on progress against the obligations set out in case law and in the Cross-border Healthcare Directive;

- Provide leverage and leadership in specific areas/disciplines.
